Terms of Service

These terms apply to Altus Air, the operations software made by Altus Air Tech LLC ("we", "us"), including the web app at app.altusairtech.com and the Altus Air mobile app. By using Altus Air you agree to them. If you use Altus Air on behalf of an operator, you agree to them for that operator too. A signed agreement between us and an operator takes precedence over these terms where the two differ.

1. The service

Altus Air helps air-charter operators run scheduling, quoting, dispatch, crew, maintenance and accounting work. We may improve, change or retire features over time, and will give operators reasonable notice of changes that take something important away.

2. Accounts

• Accounts are created by an operator for its own staff and crew. Each operator is responsible for who it gives access to and for removing access when someone leaves.
• Keep your sign-in details to yourself and tell your operator, or us, if you think someone else has used your account.

3. Your data

• The operator owns the data it puts into Altus Air. We use it only to provide the service, as described in our Privacy Policy.
• The operator is responsible for having the right to put that data in Altus Air, including personal data about its crew, clients and passengers.
• If an operator connects a Google or other third-party account, Altus Air acts in that account only for the purposes the operator connected it for, and the operator can disconnect it at any time.

4. Acceptable use

Don't use Altus Air to break the law, to send spam, to try to reach another operator's data, to interfere with the service or its security, or to copy or resell the software.

5. Aviation decisions stay with the operator

Altus Air is a tool. It does not hold an air carrier certificate and does not make operational control decisions. The operator and its certificated personnel remain responsible for every flight, for compliance with the Federal Aviation Regulations and other law, and for checking what the software shows, including schedules, duty calculations, risk assessments, maintenance status, weight and balance, and prices.

6. Fees

Fees, if any, are set out in the operator's order or agreement with us.

7. Ending use

An operator can stop using Altus Air at any time. We may suspend or end access for a serious breach of these terms, or where the law requires it. When an operator leaves, it can ask us for an export of its data, and we will then delete it as described in the Privacy Policy, except for anything we must keep by law.

8. Warranties and liability

We work to keep Altus Air accurate and available, but it is provided "as is", without warranties of any kind to the extent the law allows. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees the operator paid us in the twelve months before the claim.

9. Changes to these terms

If we change these terms, we will update the date at the top of this page and tell operators about significant changes before they take effect.
